Babywith Terms of Service
Effective date: October 6, 2026
Last updated: October 12, 2026 (added text message terms in Section 9)
Welcome to Babywith! These terms are an agreement between you and Babywith LLC ("we", "us" or "Babywith") about your use of the Babywith app and website. By signing up for or using the Platform, you confirm that you have read and agree to these terms and our Privacy Policy. If you register as a caregiver, you must also agree to the Service Provider Agreement.
1. What Babywith Is
- Babywith is an information platform that helps Chinese families overseas ("Families") and maternity nannies, nannies and housekeepers ("Caregivers") find each other, with tools for messaging, interview scheduling and electronic contracts.
- Babywith is not an agency and is not any Caregiver's employer. Families and Caregivers decide for themselves whom to work with. The services, schedule, location and pay are agreed between them, as set out in the contract they sign.
- Babywith reviews Caregiver IDs and reviews, but cannot verify everything users provide and does not run criminal or other background checks. Please decide for yourself whether someone is a good fit before working together, for example by interviewing them, checking certificates and reading past reviews.
2. Your Account
- You must be at least 18 years old to sign up. Caregivers must also be legally allowed to work in their country or region.
- Please provide true and accurate information. Caregivers must use their real name and their own photos. Keep your information up to date.
- Your account is for your use only. Keep your phone and password safe. Anything done through your account is treated as done by you.
- You can delete your account in the app at any time.
3. Interviews, Bookings and Contracts
- Families can send Caregivers interview requests or contract bookings in the app. For a contract booking, the Family fills in the schedule, pay and other terms. Once both sides confirm, they sign an electronic contract in the app.
- Both parties agree to sign electronically. Electronic signatures have the same effect as handwritten ones. Once signed, both parties must perform the contract.
- The parties to the contract are the Family and the Caregiver. Babywith is not a party to the contract and does not guarantee its performance.
4. Fees
- Contract fee: when a Family makes a contract booking in the app, the Family pays Babywith a contract fee. The amount depends on the length of the contract and is shown in the app before payment. This fee is paid by the Family. Babywith does not charge Caregivers and does not deduct anything from their pay.
- Payment: payments are processed by Stripe. The amount is first authorized and held, and is charged only once the contract is in place. You agree that Babywith may keep the card you pay with on file through Stripe, to charge any cancellation guarantee under this section. Your card number is held by Stripe, not by Babywith.
- Refunds: if a booking is cancelled before the service starts, the cancellation rules shown in the app apply. Once the service has started, the contract fee is non-refundable.
- Cancellation guarantee:
- When making a contract booking, a Family may set a cancellation guarantee in the contract. Babywith charges nothing at signing.
- If the Family cancels after the contract takes effect and before the service starts, the guarantee is charged by the timing and share set in the contract: nothing if cancelled within 48 hours of signing or 28 or more days before the start date; half if at least 14 but fewer than 28 days before; the full amount if fewer than 14 days before. If the start date is moved later by an amendment, the timing is counted from the earliest start date agreed before the change. Nothing is charged if the cancellation is caused by the Caregiver.
- Before charging, Babywith will notify you. You may object in the app within 48 hours of the notice, and Babywith will decide after looking into it. If you do not object, Babywith charges the card you used to pay the contract fee.
- This amount is collected by Babywith to compensate the Caregiver for the loss caused by the late cancellation. How the Caregiver is compensated is agreed separately between Babywith and the Caregiver.
- If the charge does not go through, Babywith will ask you to pay it another way. If you refuse, Babywith may act under Section 7.
- If a Family reverses a payment of a cancellation guarantee owed under the contract through their bank without good reason, Babywith may recover the amount from the Family and restrict or close the account.
- Pay: the Caregiver's pay is paid by the Family directly to the Caregiver as the contract states. Babywith does not handle it and is not responsible for it. Each party is responsible for its own taxes and insurance as required by law.
5. Reviews
- Families can review Caregivers after a service, and Caregivers can review Families. Families who did not book through Babywith must upload proof of employment before their review of a Caregiver is published, after Babywith approves it.
- All reviews are shown after they are approved. Reviews must be honest and based on your own experience, and must not contain insults, discrimination, other people's private information or content unrelated to the service.
- You must not post fake reviews, review on someone else's behalf, or offer money or other benefits in exchange for positive reviews or for removing negative ones.
- Babywith may remove reviews that break these terms.
6. Rules of Use
When using the Platform, you must not:
- Post false, misleading or illegal content, content that violates others' rights, or impersonate anyone.
- Harass, threaten, discriminate against or defraud other users.
- After meeting someone in the app, privately agree to skip the contract booking to avoid the contract fee.
- Use the Platform to advertise or solicit business, or use information from the Platform to compete with Babywith.
- Scrape Platform content with automated tools, or attack or interfere with the Platform's systems or security.
7. Violations
If you break these terms or the law, depending on how serious it is, Babywith may remove content, limit features, or suspend or permanently close your account. Suspected illegal conduct will be reported to the authorities.
8. Content and Intellectual Property
- You own the photos, introductions, job posts, reviews and other content you post. To run and promote the Platform, you allow us to display and use this content on and off the Platform, for example showing a Caregiver's public profile on share cards and in promotional materials.
- Only post content you have the right to post. Before uploading photos of other people (such as babies), get permission from them or their parent or guardian.
- The Babywith name, logo, app design and other Platform content belong to us and may not be used without permission.
9. Notifications
We send verification codes and notifications about interviews, bookings, contracts, messages and new jobs by push notification, in-app message and text message. You can turn off some of them in the app under "Settings → Notifications" or in your phone's settings, except necessary ones such as verification codes.
Text message notifications
- Content: notifications about your account, such as interview invitations, booking requests, schedule changes and reminders. Some messages include a secure link to view the details and respond on our website. We do not send advertising or promotional content by text message.
- Consent: we send you notification texts only after you check the text message consent box on our website (sign-up or job application page), or turn on text notifications in the app under "Settings → Notifications". Consent is not a condition of signing up for or using the Platform. Verification code texts are not notification texts.
- Frequency and cost: message frequency varies based on your activity. Message and data rates may apply, charged by your mobile carrier.
- Opt out: reply STOP at any time to stop receiving notification texts. We will send one message confirming that you have been unsubscribed. Reply START, or turn text notifications back on in the app, to opt back in. Reply HELP for help, or email hello@babywith.com.
- Carriers are not liable for delayed or undelivered messages.
- Your mobile number and text message consent are handled under our Privacy Policy. We do not share them with third parties for marketing or promotional purposes.
10. Disclaimers and Limitation of Liability
- The Platform is provided "as is". We work to keep it running smoothly but do not guarantee that it will be uninterrupted or error-free.
- Disputes between Families and Caregivers about service quality, pay, contract performance, injury or property damage are resolved between them. Babywith may help by providing chat records, the contract and similar information, but is not a party to the dispute and is not liable for it.
- To the extent permitted by law, we are not liable for any indirect damages arising from your use of the Platform, and our total liability is limited to the fees you paid to Babywith in the 12 months before the dispute arose.
11. Changes to These Terms
We may update these terms. We will notify you of important changes in the app. If you keep using the Platform after a change, you agree to the updated terms.
12. Governing Law and Disputes
These terms are governed by the laws of the State of California, USA. Any dispute arising from these terms or your use of the Platform should first be resolved through good-faith negotiation. If that fails, either party may bring the dispute before a court of competent jurisdiction in the State of California.
13. Contact Us
If you have any questions about these terms, please email hello@babywith.com, or contact us in the app under "Settings → Contact Us".
Babywith Privacy Policy
Effective date: October 5, 2026
Last updated: November 4, 2026 (accounts created when you write a review on our website in Section 1.1; AI reading of job descriptions and voice input in Sections 1.4 and 4; usage records in Section 1.7)
Babywith (operated by Babywith LLC, "we" or "us") cares about your privacy. This policy explains what information we collect when you use the Babywith app and website (together, the "Platform"), how we use it, who can see it, and your rights. Terms not defined here have the meanings given in our Terms of Service.
1. Information We Collect
1.1 Account Information
- Phone number: used to sign up, sign in and receive verification codes.
- Password: if you set one, we store only an encrypted version and cannot see the original.
- WeChat sign-in: if you sign in with WeChat, we receive the nickname, profile photo and account identifier that WeChat provides.
- Reviews written on our website: if you write a review of a caregiver on our website, we use the phone number you verified to find your account. If you do not have one, we create a family account with that phone number, so you can see your review when you sign in to the app with the same number.
1.2 Profile Information
- Families: name, profile photo, city, your baby's birth month (optional), and the jobs you post (service type, start date, number of days, price, working hours, required skills and description).
- Caregivers: legal name (as shown on their ID), profile photo, city and service areas, introduction, service type and price, years of experience, work history, skills, certificates, photos and availability.
1.3 Identity Verification (Caregivers Only)
Caregivers upload a photo of their ID and a photo of themselves holding it when they register. These photos are used only for us to verify identity. They are never shown to families or other users.
1.4 AI Reading (Optional)
- Resumes (caregivers only): if you upload a resume (a PDF file or photos) when you register, we send it to a third-party AI service provider to read it and fill in the sign-up form. Your resume is deleted after it is read. It is not stored on the Platform and is never shown to families.
- Job descriptions (families only): if you describe what you need in your own words when posting a job (by typing or by voice), we send that text to a third-party AI service provider to pick out the city, type of care, start date, length, pay and other details and fill in the job form, which you review before posting. With voice input, Apple's speech recognition service turns what you say into text; we do not receive or store the recording.
- Jobs we post for you: if you send us your needs through WeChat or other channels and ask us to post the job for you, we may give the text or screenshots you send to our AI service provider to fill in the job.
- The AI service provider we use has committed not to use content submitted through its API to train its models.
1.5 Activity on the Platform
- Chat messages, interview requests, bookings and contract records.
- Electronic contracts: the legal name and signature you provide when signing, and the contract terms.
- Reviews: review text, rating and photos, and the proof of employment uploaded by families who did not book through the Platform. Proof of employment is used only for review moderation and is never made public.
- Favorites, blocks and reports.
1.6 Payment Information
When families pay the contract fee, card details are handled directly by our payment processor, Stripe. We never receive or store full card numbers. We keep only records such as whether a payment succeeded, the amount and the time.
1.7 Device and Log Information
To send push notifications, fix problems and keep the Platform secure, we collect your push token, device model, operating system version, app version, IP address and error logs. We do not collect your precise location (you choose your city yourself), and we do not access your contacts.
To understand how features are used, we also record some of your actions on the Platform, such as how far a caregiver got in sign-up and which item was not filled in, and which kind of card you shared. When a shared link is opened, we record which kind of card was opened. These records are used only to improve the Platform, not for advertising.
1.8 Text Message Consent Records
If you opt in to or out of notification texts, we record the phone number, the time, how you did it (which page you checked the box on, or replying STOP), the version of the disclosure you saw, and your device and IP address, to keep a record of your choice.
2. How We Use Information
- To provide the Platform: show profiles, match jobs, deliver messages, schedule interviews, sign contracts and process contract fees.
- For verification and safety: verify caregiver identities and reviews, handle reports, and prevent fraud, impersonation and abuse.
- For notifications: send you reminders about interviews, bookings, contracts, messages and new jobs. You can turn off some of them in the app under "Settings → Notifications".
- To improve the Platform: understand how features are used and fix problems.
- To comply with the law: meet legal obligations and respond to lawful requests from authorities.
3. Who Can See Your Information
- Caregiver profiles (legal name, photo, city, introduction, price, experience, photos, reviews, etc.) are public and can be seen by anyone on the Platform, including visitors who are not signed in, and parents can search for caregivers by name. The legal name a caregiver provides at sign-up is the name shown publicly.
- Jobs posted by families are shown to caregivers. A family's profile can be seen by a caregiver when the family contacts them, schedules an interview or makes a booking.
- When a contract is signed, each party can see the legal name and signature the other party provided.
- Approved reviews are shown on the reviewed person's profile.
- ID photos, resumes, proof of employment and your phone number are never shown to other users.
4. Who We Share Information With
We do not sell your personal information or share it for cross-context behavioral advertising. We share only what is necessary, and only in these cases:
- Service providers: companies that help us run the Platform, including Amazon Web Services (servers, database, file storage and SMS), Stripe (payments), our AI service provider (reading resumes and job descriptions), Expo and Apple (push notifications; Apple also provides speech recognition for voice input), and WeChat (sign-in and sharing). They may use the information only to provide their services to us.
- Legal requirements: to comply with the law, a court order or a lawful request from authorities, or to protect the safety and property of users, others or us.
- Business changes: if we are involved in a merger, acquisition or sale of assets, your information may be transferred, and the recipient must continue to follow this policy.
Text messaging: we do not sell, rent or share your mobile number or text message consent with third parties or affiliates for marketing or promotional purposes. None of the sharing described above includes text message opt-in data or consent. Your mobile number is provided only to our SMS service provider (Amazon Web Services) to send the messages you have agreed to receive.
5. Storage and Security
- Your information is stored on servers in the United States. If you use the Platform from Canada or elsewhere outside the United States, your information will be transferred to, stored and processed in the United States, and may be subject to U.S. law, including lawful access by U.S. authorities. We protect it with measures such as encrypted connections and access controls, but no system can be guaranteed to be completely secure.
- We keep your information only as long as needed to provide the Platform and comply with the law. When you delete your account, we delete or anonymize your personal information, except for contracts and transaction records we must keep by law, and reviews that have already been published.
6. Your Rights
- View and edit: you can view and edit your profile in the app at any time.
- Delete your account: you can delete your account in the app under "Settings → Account".
- Turn off notifications: you can turn off push notifications in the app or in your phone's settings.
- Opt out of texts: reply STOP at any time, or turn off text notifications in the app under "Settings → Notifications".
- California residents: under the California Consumer Privacy Act (CCPA), you have the right to know what personal information we collect about you, to request that it be deleted or corrected, and not to be discriminated against for exercising these rights. We do not sell your personal information or share it for cross-context behavioral advertising. To exercise these rights, please email us.
- Canadian residents: under the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws, you have the right to request access to the personal information we hold about you, to ask us to correct inaccurate information, and to withdraw your consent to our collection and use of your personal information (after which we may not be able to continue providing some services). To exercise these rights or to raise a question or complaint, please email us. You may also file a complaint with the Office of the Privacy Commissioner of Canada.
7. Minors
The Platform is only for people 18 and older. Your baby's birth month, if a family provides it, is used only to match jobs. If you learn that someone under 18 has registered, please contact us and we will delete their information.
8. Changes to This Policy
We may update this policy. We will notify you of important changes in the app. If you keep using the Platform after a change, you agree to the updated policy.
9. Contact Us
If you have any questions about this policy or your personal information, please email hello@babywith.com, or contact us in the app under "Settings → Contact Us".
